When CPS presents a parent with this safety plan and claims that it must be signed or their child will be placed in foster care, they are not telling the whole story. According to the law, a child may not be removed from their home without a court order unless exigent circumstances exist. Exigent circumstances means that the situation requires immediate action and many times this is simply not the case.

Signing the safety plan gives CPS control. Although every case is different, it is often better for the parent to have their case heard in court.
